Swimming pool registration

As per the Swimming Pools Act 1992 - Part 3A, the swimming pool must be registered. This application cannot be lodged if the pool is not registered.

  • A NON-REFUNDABLE APPLICATION FEE OF $150 IS PAYABLE AT THE TIME OF LODGING THIS APPLICATION.

  • A FEE OF $100 IS ALSO APPLICABLE IF A SECOND INSPECTION IS REQUIRED.

  • COUNCIL WILL NOT PROCESS AN APPLICATION WHERE THE FEE HAS NOT BEEN PAID.

Rights of appeal

  1. You are entitled to appeal to the Land & Environment Court should Council determine to refuse the application.

  2. For the purpose of the appeal proceedings arising in connection with an application under Section 24 of the Swimming Pools Act 1992,  Council is taken to have refused the application if it has not finally determined the application within six weeks of the application being made.

Swimming Pools Act 1992 - Section 22D

The requirements for the issue of a certificate of compliance in respect of a swimming pool are that:

  1. The swimming pool is registered under Part 3A, and

  2. The swimming pool complies with the requirements of this Part.

A local authority must issue a certificate of compliance in respect of a swimming pool if the local authority has:

  1. Inspected the swimming pool under this Division, and

  2. Is satisfied that the requirements for hte issue of a certificate have been met.

Please note:

  1. A certificate of compliance is to be issued to the owner of the property.

  2. A local authority can refuse to issue a certificate of compliance until any fee payable for the inspection has been paid.

  3. A certificate of compliance remains valid for the period of 3 years from the date on which it is issued but ceases to be valid if a direction is issued under section 23 in respect of the swimming pool to which the certificate relates.
