In accordance with Council’s administrative guidelines and hardship assistance policy this agreement enables a ratepayer who is the recipient of Council’s pensioner concession rebate to apply to defer the payment of rates, charges and interest. Council may agree to allow the accrual of pensioners' rates charges and interest against the future estate or sale of the land in appropriate cases for a period of up to 19 years.
CONDITIONS OF AGREEMENT
  • All ratepayers listed as owners with NSW Land Registry Service, are required to declare their agreement to defer rates, charges and interest for the property.

  • This agreement allows Council to delay the commencement of recovery action for the collection of rates, charges and interest for a period of up to 19 years from the time the rates and charges became due and payable.

  • A period of 19 years is determined from the due date of the earliest overdue amount.

  • The ratepayer is required to make payment of overdue rates and charges such that their total debt to Council does not exceed the period of 19 years.

  • In accordance with the Act, any payments will be applied towards the payment of rates and charges in the order in which they became due and payable.

  • If the conditions of this agreement are not adhered to, or a suitable payment arrangement is not entered into, Council’s Administrative Guidelines for Debt Recovery of Rates and Annual Charges will apply.

TERMS OF AGREEMENT
  • The ratepayer/s requests that Canterbury-Bankstown Council give consideration to allowing the deferment of rates, charges and interest on the above property due to financial hardship.

  • The ratepayer/s understands that debts will accrue until:

    • there is a change in the ownership of the property through sale or Estate, or

    • the ratepayer/s should leave the property but retain ownership, (e.g. move to a hostel, nursing home or other accommodation), or

    • the ratepayer/s becomes ineligible for a pensioner concession.

  • The ratepayer/s understand that the outstanding rates and annual charges are subject to interest in accordance with the Local Government Act, 1993.

  • The ratepayer/s understands that, if the rates and annual charges remain unpaid for a maximum period of 19 years then the applicant will commence payment of the rates and charges by periodic instalments to ensure that no more than 19 years outstanding remain at any time.

  • The ratepayer/s understands that if the debt exceeds 19 years, Council may be required to formally secure the debt in accordance with the Local Government Act 1993.
