ABOUT THIS FORM

A Notice of Discontinuance (NOD) is filed by Council’s Legal Recovery Firm, Recoveries and Reconstruction (Aust.) Pty Ltd (R&R) to conclude legal proceedings, when the action has progressed to Judgment. Once filed, the document prevents either party from taking any further action on the legal file with the Court and confirms the legal account is closed.

The Consent Orders (CO) to set aside Judgment is a document filed with the Court requesting that the Judgment listed be removed. The consent orders are required as a part of the NOD process to assist the applicant to have their credit file details and credit scores updated.

NOTES TO RATEPAYER

A valid email address must be provided for Council to issue the documents.
Once all conditions of the agreements have been met, Council will instruct R&R to issue the NOD & CO and any further enquiries should be directed to R&R on 1300 556 863.
Documentation will be sent to the applicant by R&R. Instructions to execute and return the documents to R&R must be followed for the NOD & CO to be filed at the local court.
Council has no role in the entry or removal of default Judgment. The listing of default Judgment is done under a commercial agreement directly between the Attorney General’s Department and the credit agencies. The applicant is responsible for sending court signed NOD & CO to any relevant party.

CONDITIONS OF AGREEMENT

All overdue rates and charges inclusive of any applied legal costs and interest must be paid up to date prior to submitting the application or it will not be processed. To obtain a current outstanding balance, Customer Service should be contacted on 02 9707 9000.
In accordance with Council’s fees and charges, the request for a NOD & CO will incur an administration fee payable to Council upon submission of this application.
