STALL REQUIREMENTS AND FEES

DEFINTIONS

Food Outlet: For the preparation and sale of ready to eat food, requires food preparation and or cooking, not sold and served in suppliers original packaging i.e. hot dogs, ice cream, sausage sizzle.

Packaged Food Outlet: For the sale of food products that do not need be consumed immediately, do not require temperature control, served in packaging, do not require food handling at the event such as jam, candy and sauces.

Local Business: Business or owners reside within the Canterbury-Bankstown Local Government Area

Stall category

Please note: Standard Food Stall size is 3m x 3m. Food van / trailer will vary in cost depending on size.

Where nonstandard infrastructure is requested for items without listed charges, fees will be charges on a cost recovery basis.

Please Note:  Bankstown Bites 2025 will be accepting up to a total of 30 Food Stalls/Trucks combined. 

COSTINGS: As per 2024/25 Fees and Charges. (please select from the following options) 

** All stallholders must provide their own power leads and power boards. All power leads and power boards must be waterproof plus tag & tested prior to Event day. 

## This may be required if your food truck has not operated in the City of Canterbury Bankstown previously. This is at the discretion of council staff and would be conducted before the event.

POWER

Unless requested on the application form, power will not be available (**Council encourages stallholders to be self-sufficient with own Australian Standard power supply).

PLEASE NOTE: 

  • WE DO NOT PROVIDE ELECTRICAL LEADS OR ADAPTORS.

  • You are responsible for supplying sufficient tagged electrical leads and adaptors for connection to power supply. (All power leads and adaptors will be inspected on the day). 

  • All power leads and power boards must be waterproof.

  • Council will not take responsibility for any damages caused to your electrical equipment generated from power supply, provided to you at the Event.  

  • Provision of power for each outlet $50 + GST.

Please note:

  • In line with State and Federal plans to address the issue single-use plastics have on our environment, Council endorsed a Single-Use Plastic Policy and Plastics Action Plan. Under the Plastics & Circular Economy Act 2021, the NSW Government has recently banned lightweight plastic bags (<35 microns thick). Fines may be issued by the EPA for continued use. This applies to all businesses, organisations and groups (charitable, sporting, education and community etc). Therefore, all food and drinks must be sold/supplied in biodegradable or recyclable containers. For more information on what suitable alternatives will be for these items, please visit  https://dpe.mysocialpinpoint.com.au/plastics-ban-nsw

  • No balloons are to be sold or given away.

  • All food stalls MUST attach a Food Safety Supervisor Certificate and comply with the ‘ NSW Food Authority Guidelines’.

Stallholder Terms and Conditions

Applications

• Council reserves the right to accept or reject any application.

• To ensure the quality and diversity of our events, Council applies criteria for the selection of stallholders. Council reserves the right to refuse applications regardless of the date the application is sent in.

• Applications are assessed on several criteria including (but not limited to): Correct completion of the application form; correct insurance provided; type, quality and suitability of product; base of operations; presentation of stall/vehicle; date received, invoice paid.

• Council attempts to avoid duplications of products sold, therefore some stalls are not accepted for reasons of duplication.

• Council’s decision on stall selection and location of stalls is final. No correspondence will be entered into.

• Stalls are non-transferrable and cannot be sub-let.

• Applications will not be processed without a Public Liability Insurance certificate of currency in the name of the Business/ Trader and for minimum coverage of $20 million.

• Stallholders acknowledge that Council is not responsible for cancellation of the event due to bad weather on the scheduled date and that fees are not refundable.

• You can only sell what you have listed on the application form in “Full list of food/ goods to be sold/ provided on the day”

• Art/Craft outlet- items must be made by you or a close associate and be of high quality. Samples or photos may be requested as evidence.

• Dangerous or harmful merchandise including silly string, helium filled balloons, knives, caps and replica guns are banned.

• New stallholders may be requested to provide references.

• Council retains the right to enter any stall at any time and remove any article which in our opinion is offensive, dangerous or not suitable for the event.

• Stallholders are not permitted to have any amplified sound at their stalls. This includes but is not limited to music and spoken word.

• Games of chance including lotteries, lucky dips, raffles, etc are not permitted.

• No political stall or advertising is permitted at the event.

• Any variations from these Terms and Conditions must be requested and agreed upon in writing by the Team Leader Events and Community Experiences prior to the event start date.

• If you are successful in your application you will be notified by email.

• You must agree to all terms & conditions to apply for a stall.

• Failure to comply with all terms & conditions may result in a forfeit of the application fee and/or your stall may be closed and/or removed from site.

Access and trading hours

Trading only during the specified time period.

• Stallholders must continue to trade for the entire duration of the event unless directed otherwise by event staff.

• The site speed limit is 5km/h.

• There will be no vehicle entry to the event site other than the allocated bump in and bump out times, or at the event coordinator’s discretion. 

• All equipment/unsold stock to be cleared by the completion of the event.

• All equipment must be packed and ready to load prior to bringing your vehicle on to site.

• Stallholders who do not arrive during the designated set up period will be deemed to have relinquished their position.

• No parking will be available on site.

• Council will not accept responsibility for any traffic infringements, damage to vehicles/equipment etc, which may be incurred.

Public/product liability Insurance

• You must have your own public liability insurance to a value of at least $20 million to cover your operations throughout the event.

• Insurance must be valid for the duration of the event.

• The name listed on the insurance policy MUST match that on this application under Business Name or Trading Name.

• City of Canterbury Bankstown must be listed as an interested party.

Site Location

• A site plan detailing the position of your stall will be sent after your application has been approved.

• The location of all stalls is at the discretion of Council.

Power Access

• All stall holders are responsible for supplying (waterproof) tagged and tested electrical leads and adaptors for connection to power.  (All power leads and adaptors will be inspected on the day). 

• You must ensure that all electrical equipment is in good working order and meets Australian safety standards.

• You must indicate if you require power at the time of making your application, otherwise Council cannot guarantee power availability.

• Requests for power are solely a request and Council may not be able to accommodate requests under certain conditions.

Council will not take responsibility for any damages caused to your electrical equipment generated from power supply, provided to you at the Event.  

Waste Wise Event

• No polystyrene to be used.

• Drinks must be sold/supplied in biodegradable or recyclable containers.

• General waste & recycling bins will be provided by Council, which will be emptied by council staff when required.

• Each stallholder is required to keep their stall clean and well presented at all times.

• Stallholders are responsible for the removal from site all rubbish and all plastic trays (such as bread trays and milk crates).

• No balloons are to be given away or sold.

Payment

• Once the application has been approved you will be invoiced and required to pay within two (2) weeks of approval notification.

• Once your stall has been approved to operate, payment must be made in full by the due date to secure a place. If payment is late, you may risk losing your position at the event.

• Any expenses incurred due to damage by the stall holder will be charged to the stallholder at cost.

Work Health & Safety

• You must familiarise yourself and comply with any WHS regulations relative to your business.

• Compliance with these terms & conditions does not negate your legal responsibilities under the Work Health and Safety Act 2011 and its regulations.

• No person in the stall area must be under the influence of alcohol.

• No smoking within 10 metres of any stall.

• No children under the age of 15 to be in the food stall area.

• All stalls containing cooking facilities MUST provide a fire extinguisher and/or blanket.

• Stallholders are advised to bring their own small first aid kit.

• Stalls taking a space only and providing their own structures must bring adequate weights to secure the structure safely and without causing trip hazards.

• Open toed shoes are not allowed on site at any time, this includes sandals and thongs.

• Hi-vis vests must be worn at all times on site during set up and pack down.

  • Authorised Council Officers or emergency services may require an activity to cease at any time. The activity may be required to cease if it is deemed to be causing an inconvenience, harm to the public or property, a nuisance or causing offence to the public or property. The activity must comply immediately to any request to suspend, relocate or cease the activity.

Food Stalls

• All temporary food premises must comply with the requirements of the NSW Food Authority “Guidelines for Food Businesses at Temporary Events” which can be found at http://www.foodauthority.nsw.gov.au.

• Under the NSW Food Act 2003, all temporary food handling businesses in NSW are required to “notify” their details to the NSW Food Authority.

• All food stalls will be inspected by Council Environmental Health Officers before and during operations and penalties may apply to those that fail to comply with the regulatory food handling processes. Serious breaches will result in the immediate closure of the stall by event management as well as other penalties.

• All food businesses must appoint a Food Safety Supervisor (FSS) for the premises. A copy of the FSS Certificate must be submitted to Council with this application and must be kept on the premises.

Covid-19

  • Good personal hygiene with frequent hand washing.

  • Follow the Covid Safety Plan and current public health orders.  .

Cancellations

• Council must be notified of cancellation in writing via email events@cbcity.nsw.gov.au

• There will be no refunds for any reason within (1) month of the event. Any cancellations within one (1) month of the event, including any no shows on the day will incur a 100% cancellation fee.

• 50% cancellation fee applies for any stalls who cancel prior to one (1) month before the event

• Council reserves the right to cancel a event for any reason in which case any fees paid by the stallholder shall be refunded; and the stallholder shall have no right to make a claim upon Council for any loss or damage consequent upon such cancellation

Wet Weather

• In the event of wet weather, the festival will continue unless deemed unsafe by the Team Leader Events and Community Experiences.

• Money paid will NOT be refunded.

• There will be no re-location of the stalls on the day of the event.

• Please note it is the stallholder’s responsibility to prepare for the possibility of wet weather by bringing portable shelters/tarps which must be properly secure

Disputes

  • On the day of the event, the decision of Council event staff is final and must be adhered to. If there is a dispute regarding this decision it must be pursued after the event in writing to the Coordinator Events.

Declaration

I declare that the information that I have provided in this application is true and correct. If granted a Permit, I agree to comply with the conditions of use in association with that permit including by not limited to:

I have read and understood the terms and conditions outlined for this application;

I will abide by the conditions outlined in the permit issued to me;

I will notify City of Canterbury Bankstown if there are any significant changes to my application including contact details;

I will agree that all permits are non-refundable. I acknowledge that information found to be false in support of the application will result in my permit being cancelled.
