Process to gain commercial use of street parking space

  1. Application form received with all information provided.

  2. Council will review the application and inspect the area requested for approval.

  3. Council will forward approval/refusal letter to applicant, with invoice for licence payment if required.

  4. When invoice payment is received, Council will deliver approval notification.

  5. Annual licence fee invoice is sent on approximately 1 July each year to maintain approval.


Application fee

The application fee must be paid prior to the application being processed. It is a non-refundable fee that covers the processing of the application. The fee is not refunded if the application is not approved.

Application details

1. Trading hours: 

Note: As a guide, trading hours will be assessed on a case-by-case basis and the existing footway dining approval hours (if applicable) will be taken into consideration. Maximum hours in Canterbury-Bankstown for cafes, unlicensed, licensed restaurants, pubs and small bars are:

  • 7am to 10pm Sunday to Thursday

  • 7am to 11pm Friday to Saturday

2.  Provide a description of the parklet proposal and details of proposed embellishments. In your description, you must identify its intended use, patron capacity (no more than 1 person per 1 square metre) proximity to existing footway dining approval and the proposed location, any furniture to be included (chairs, tables, umbrellas, heaters) etc.

3.  Artistic treatment: Council requires successful applicants to consider the look and feel of their parklets. In instances where standardised concrete or water filled barriers will be used, applicants need to incorporate our City Brand logo – Where Interesting Happens. Applicants also have the option to use Council designs outlined in the Street Parklet Guidelines.

Conditions of approval

  • Payment of the application fee does not confirm approval.

  • No objects are to be placed on car parking space, until written approval from Council is received. Should any objects be placed on the car parking space without approval, Council may issue a fine.

  • If the application is approved, a licence fee is payable. The licence fee is due each year on 1 July. The licence fee for the first year will be calculated on a pro-rata basis and will depend on the location in Canterbury-Bankstown and existing town centre environments. Fee enquiries can be made with Council’s Customer Service Centre on 9707 9000.

  • Applicants must address all criteria in Council’s Street Parklet Policy and the Street Parklet Guidelines and work with Council to help achieve the aims and objectives of the policy.

  • The use of the premises shall comply with the provisions and requirements of the Smoke-Free Environment Act 2000 and the Smoke-Free Environment Regulation 2000.

  • This applicant becomes the permit holder and is responsible for ongoing management and maintenance of the commercial use area.

  • Should your Insurance Policy be cancelled for any reason, you must notify Council immediately.

  • The Licence Agreement between Council and the applicant is formed from:

  • This application form;

    • Council's signed letter of approval, with any special conditions;

    • The Street Parklet Policy; and

    • The Street Parklet Guideline.
