I, the Customer, have read, understood and agreed to abide by Canterbury-Bankstown Council’s (
Council) Studioventure Terms and Conditions.
I agree to be fully responsible for the payment of fees and any additional charges for the Studioventure services in accordance with the Terms and Conditions that have been supplied to me.
I declare that the information supplied by me on this form is complete, true and correct to the best of my knowledge.
* THE CUSTOMER ACKNOWLEDGES THE SERVICES BOOKING IS NOT CONFIRMED UNTIL THE SNAPFORM APPLICATION HAS BEEN SUBMITTED AND APPROVED BY STUDIOVENTURE AND FULL PAYMENT HAS BEEN RECEIVED.
* ALL SERVICES BOOKINGS MUST BE SUBMITTED A MINIMUM 2 BUSINESS DAYS BEFORE THE REQUESTED SERVICES DATE UNLESS AGREED PRIOR BY STUDIOVENTURE
1. AGREEMENT
a) The Customer agrees to abide by Studioventure’s Terms and Conditions.
2. PROHIBITED BOOKINGS
a) Studioventure will not accept services bookings to produce content that contains pornography; gambling; piracy; is obscene or indecent; depicts violence; contains instructions in crime or druguse; defames, harasses, menaces, threatens, abuses, offends or embarrasses any person; infringes the copyright, moral rights, confidentiality rights or intellectual property rights of any person, for example, by reproducing songs, poems, articles, logos, trademarks, pictures, photos, music or other material that is not owned by the Customer (or which the Customer does not have a license to reproduce on the site).
3. INDEMNITY AND RELEASE
a) The Customer agrees to indemnify and release Council and/or Studioventure from and against all actions, claims, costs, losses, expenses and damages (including the costs of defending or settling any action or claim) in respect of loss of, loss of use of, or damage to property of the Customer; and personal injury (including death) or illness to any person resulting from or by reason of anything done or omitted to be done by the Customer
b) The Customer’s liability to indemnify Council and/or Studioventure is reduced proportionally to the extent that a negligent act or omission of Council or its employees has contributed to the injury, damage or loss
c) Studioventure is not liable for the content produced. The Customer acknowledges that liability of the content produced rests solely with the Customer. The Customer indemnifies and holds Studioventure harmless for any claims or legal actions related to the content produced
d) Studioventure does not accept responsibility and/or liability for the loss or damage of personal belongings and equipment held on-premises by the Customer and those associated with them
e) The Customer will be liable for any loss or damage caused to the premises, contents and equipment of Studioventure. Any loss/damage incurred will be charged at full replacement cost to the Customer
f) The Customer agrees not to sue or make any claim or demand against Studioventure and/or Council in respect of matters covered by this release.
4. STOCK IMAGES AND VIDEOS
a) All stock images and videos to be used by the Customer in the production are to be provided by the Customer
b) Studioventure will not under any circumstances provide Customers with stock images and videos
c) It is the responsibility of the Customer to obtain all necessary permissions, licences, and authorities in respect of any stock images and videos the Customer intends to use.
5. COPYRIGHT
a) Studioventure is not liable for any final videos and has no copyright claim. All final edited videos become the intellectual property of the Customer.
6. INSURANCE
a) It is the responsibility of the Customer to arrange its own Liability Insurance to cover the Customer and any of the Customer’s Team and/or Equipment during the services booking
b) Loss or damage to the Customer’s property or equipment is not covered by Council’s insurance policy.
7. GENERAL CONDITIONS OF USE
a) The Customer must be at least 18 years of age. You may be required to supply photo ID
b) The Customer must adhere to the capacity limit of ten (10) people (including the Customer) in Studioventure at any given time not including the backdrop/set area where a maximum capacity of five (5) people at any given time per booking is to be adhered to
c) The Customer is required to be at the premises or nominate a representative 18 years or older for the duration of the services booking. It is the Customer’s responsibility to supervise the duration of the services booking
d) The services booking is personal to the Customer. It cannot be assigned in whole or in part. This means that you cannot impart your responsibilities on to other parties or sub-book to others
e) The Customer must not make any changes / additions or undertake any building works to the structure of Studioventure without prior written Studioventure consent. This includes the use of nails and screws on the walls
f) It is the responsibility of the Customer to ensure the health and safety of any and all persons in attendance throughout the services booking
g) It is the responsibility of the Customer to inspect the Studioventure premises throughout the services booking to ensure its condition is safe and fit for the purpose. Any issues should be reported to Council as soon as possible
h) The Customer must not remove or permit the removal of any furniture, equipment or contents from Studioventure without the permission of Studioventure
i) The Customer must not use the premises for any activity which may pollute the environment
j) No animals are permitted in Council premises, other than guide dogs for the visually impaired or registered companion animals and official animals of the NSW Police
k) The Customer must respect other users of Studioventure at all times throughout the services booking
l) Studioventure must be kept in a clean and tidy state at all times and comply with Work, Health and Safety regulations.
8. NOT-FOR-PROFIT ORGANISATIONS
a) Not-For-Profit organisations seeking the discounted community rate are to provide documentation that proves your organisation’s not-for-profit status. Please provide a copy of one of the documents below (must include your Customer name):
❒ Certificate of Incorporation (from the Department of Fair Trading) OR
❒ An Authority to Fundraise (from the Department of Gaming and Racing) OR
❒ Income Tax Exempt Charity Statement (from the Australian Taxation Office)
9. QUOTES AND PRICES
a) All prices are current at the time of quotation and are subject to revision prior to confirmation, unless otherwise agreed
b) All written quotes are valid for twenty-one (21) business days from the date of quotation for tentative bookings unless withdrawn by the Customer prior to receipt of the required deposit in cleared funds
c) In the event a services booking goes overtime, the client will be charged for the additional time. This time may also be transferred to another service such as photo and video editing, subject to Council’s approval.
10. RAW FOOTAGE
a) Raw Footage means unedited source footage recorded by Studioventure and does NOT include project files, stock footage and stock images
b) The Customer may purchase a USB of the Raw Footage in viewable format from Studioventure for an additional fee
c) The Customer acknowledges that Studioventure will only retain Raw Footage for a period of 30 days following the services booking and it will then be destroyed.
11. FEES AND PAYMENT
a) Fees and charges for Studioventure are determined annually by Council. For a full list of current fees and charges visit cb.city/Studioventure
b) Studioventure can only accept credit card and EFTPOS payments in person or credit card payment over the telephone Please do not send credit card information to Council and/or Studioventure by email or fax
c) Failure to pay accounts on time will result in services booking being terminated
d) Full payment must be made at least two (2) business days out from the services booking period
e) The Customer understands that no booking is confirmed until a confirmation letter/e-mail has been received
f) An emergency call out fee may be applicable if the call out is due to the Customer’s actions
g) If additional cleaning is required the cleaning charge per hour per cleaner will be charged
h) Customers are required to clean Studioventure and return it to its original state within the allocated services booking period only. If additional cleaning is required Customers are responsible for the full cost. In the event of a dispute as to whether additional cleaning is required, the decision of Council and/or Studioventure will prevail.
12. CANCELLATION INFORMATION
a) Customers must give a minimum two days notice in writing of cancellations otherwise a cancellation fee may apply
b) Studioventure reserves the right to cancel the services booking where circumstances so warrant and reschedule to another time. Reasons for cancellation may include, but are not limited to, emergency situations and adverse environmental / weather conditions, major renovations or for Council use
c) In extenuating circumstances where services bookings cannot be rescheduled, Studioventure will provide a credit to the Customer.
13. BOOKINGS
a) All bookings are to be made a minimum of two days in advance of the booking period
b) Customers must adhere strictly to the agreed services booking hours. Setting-up and packing up time must be included in the services booking period
c) Studioventure should be informed immediately in writing of any changes to services booking information such as times, contacts, address for invoice etc. An administration fee may apply when a services booking has already been confirmed in writing is amended.
14. PROHIBITED ITEMS
a) Use of resins, epoxies, oil paints, solvents, enamels, aerosols i.e. fixatives, spray paint are not permitted in Studioventure
b) Barbeques, open flames and fireworks are not permitted in Studioventure
c) Candles may only be used if secured in a suitable stand that minimises risk and prevents wax from dripping on tables or floors.
15. SAFETY AND ACCIDENTS
a) The Customer must familiarise themselves with the emergency exits, fire extinguishers, fire hoses and facility evacuation procedures in case of an emergency
b) The Customer must ensure that all exit doors and access to fire equipment are kept clear
c) The Customer should fully familiarise her / himself with any safety information provided by Council and/or Studioventure
d) The Customer must not place any substance on the floors that would alter or damage the surface
e) The Customer is responsible for ensuring that fire equipment is not discharged, used or interfered with for any reason other than its designated purpose. Council and/or Studioventure must be notified as soon as possible if equipment has been used for any purpose
f) The Customer should provide their own first aid kit.
16. FURNITURE AND EQUIPMENT
a) Furniture and equipment must be carried,
not dragged on the floor
b) It is the Customer’s responsibility to ensure that all furniture and equipment brought in externally for an activity is removed prior to the end of the services booking period. Failure to remove such equipment may result in the levying of a further fee
c) Customers are responsible for the care and the control of their own property and personal effects. Loss or damage to such items is not covered by Council’s insurance policy
d) If equipment or furniture are left at Studioventure after the services booking period, Council reserves the right to remove them, and if not claimed, to dispose of them
e) Please note that all equipment including technical theatre or audio-visual equipment is only to be set-up, operated and packed-down by Studioventure’s technical expert. Customers and clients cannot use any of the equipment.
17. CLEANING AND VACATING STUDIOVENTURE
a) Customers are responsible for ensuring they leave Studioventure clean and ready for the next user. This includes wiping down benches, tables, and sinks, removing all personal equipment
b) Rubbish is to be placed in bins provided. Recycle if possible
c) Report to Studioventure management if the Studio is not found in a clean and tidy state.
18. DECORATIONS
a) All decorations and signage (hung or adhered to any surface or wall) must be approved by Studioventure prior to your services booking period. Any costs to repair damage to wall surfaces will be recovered from the Customer
b) The Customer is responsible for removing all decorations immediately after the Studioventure services booking period
c) No live flame or ignition of any kind is allowed in Studioventure
d) Studioventure Customers are not permitted to utilise confetti, poppers, sprays, rice, bubble machines or glitter within the Studioventure
e) Smoke machines are not permitted in Studioventure under any circumstances unless approved by Studioventure management
f) Helium balloons are not permitted in Studioventure without prior written approval.
19. CHILDREN
a) All children under the age of 16 (sixteen) years must at all times be under the direct supervision of a responsible adult when in Studioventure.
20. DAMAGE / BREAKAGES / LOSS OF PROPERTY
a) The Customer is responsible for the full replacement cost of any damage or breakages to the building, its fittings, contents and grounds that take place within their services booking period. Any damage must be immediately reported to Council
b) The Customer is responsible for reporting any damages, breakages to the building, its fittings, contents and grounds which exist at the commencement of the services booking period
c) The Customer is responsible for reporting health and safety hazards
d) Council does not accept responsibility for the loss or damage of Customer’s property. Any equipment and/or property left in Studioventure is left at the Customer’s own risk.
21. SMOKE-FREE ENVIRONMENT
a) Council policy prohibits smoking in all Council facilities or within 10 metres of entrances. The Customer is responsible for ensuring that this policy is adhered to.
22. ALCOHOL / BEVERAGES / FOOD
a) Due to Council’s liquor licencing agreement no alcohol is to be brought into Studioventure by the Customer, its affiliates or third parties.
b) Food and beverage can be purchased through the BLaKC Café and must be consumed at the café premises.
